Transparency and the Bertrand Law
In accordance with Article 2 of Law n° 2011-2012 of 29th December 2011 and Decree n° 2013-414 of 21st May 2013, since 1st January 2012 HEMODIA has been required to declare and make public any agreements entered into with certain categories of companies active in the health sector, as defined by law, as well as any benefits in kind or in cash granted to those companies.
Pending the creation of a single open-access site, companies are required to declare these connections of interest on their own websites so that they are freely accessible, as of 1st October 2013, then biannually (April, October) thereafter.
In accordance with Article 39 of the Data Protection Act of 6th January 1978, health professionals and companies affected by the so-called Bertrand Law have a right of access to published information as well as a right to rectification of this information, but no right to object.
